fa مهندسی حقوقی خط‌مشی‌های آموزشی؛ بهره‌گیری راهبردی مدیریت آموزشی از ظرفیت‌های قانونی برای ارتقای کیفیت و عدالت مدیریت دولتی Public Administration پژوهشي Research این مقاله با طرح مسئله فقدان یک چارچوب تحلیلی منسجم برای بهره‌گیری راهبردی مدیریت آموزشی از ظرفیت‌های حقوقی، به بررسی این پرسش می‌پردازد که چگونه می‌توان از &laquo;مهندسی حقوقی خط‌مشی‌های آموزشی&raquo; برای ارتقای هم‌زمان کیفیت و عدالت در نظام‌های آموزشی استفاده کرد. روش پژوهش، توصیفی&ndash;تحلیلی و مبتنی بر مرور و ترکیب نظام‌مند ادبیات نظری و گزارش‌های سیاستی معاصر در حوزه آموزش و حقوق است. یافته‌ها نشان می‌دهد که حقوق نه صرفاً مجموعه‌ای از قواعد محدودکننده، بلکه زیرساختی پویا برای طراحی و بازآرایی فرآیندهای آموزشی است که در صورت بهره‌گیری هوشمندانه، می‌تواند به توزیع عادلانه منابع، ارتقای کیفیت یادگیری و کاهش نابرابری‌های ساختاری منجر شود. همچنین مشخص شد که موفقیت سیاست‌های آموزشی وابسته به توانایی مدیران در تفسیر فعال قوانین، بومی‌سازی آن‌ها در سطح اجرا و تقویت سواد حقوقی راهبردی است؛ در غیر این صورت، قوانین ظاهراً بی‌طرف می‌توانند به بازتولید نابرابری منجر شوند. در نهایت، مقاله بر ضرورت طراحی قوانین انعطاف‌پذیر، مبتنی بر پاسخ‌خواهی هوشمند و متناسب با تنوع زمینه‌های آموزشی تأکید می‌کند.<br> &nbsp; This article, by raising the problem of the lack of a coherent analytical framework for the strategic utilization of legal capacities by educational management, addresses the question of how &quot;legal engineering of educational policies&quot; can be used to simultaneously enhance quality and equity in educational systems. The research method is descriptive-analytical, based on a systematic review and synthesis of theoretical literature and contemporary policy reports in the fields of education and law. The findings indicate that law is not merely a set of restrictive rules but rather a dynamic infrastructure for designing and restructuring educational processes that, if utilized intelligently, can lead to the equitable distribution of resources, improvement of learning quality, and reduction of structural inequalities. It was also found that the success of educational policies depends on the ability of managers to actively interpret laws, localize them at the implementation level, and strengthen strategic legal literacy; otherwise, seemingly neutral laws can lead to the reproduction of inequality.
